On May 18, 2015, Patent Reexamination Board of SIPO formally issued a document which declared the entire invalidity of patent right of patent for invention of Dow Corning Toary Co., Ltd., i.e. “Curable Organopolysiloxane Composition and Semi-conductor Device Manufacturing by Using This Composition” with patent number of ZL 03824673.2 (date of application: September 8, 2003; date of priority: October 28, 2002; date of notice of authorization: February 14, 2007).

In order to fight back Dow Corning’s infringement prosecution against domestic silica gel enterprises, China Electronics Materials Industry Association held up the weapon of patent and helped domestic electronic packaging silica gel enterprises prosecute Dow Corning (China) Investment Co., Ltd. This patent dispute case lasted for 8 months and a complete victory was obtained gain.

[Event Review]

On September 4, 2014, China Electronics Materials Industry Association entrusted Linda Liu & Partners to submit an application for request of invalidity of patent involved in the case.

On March 31, 2015, Patent Reexamination Board of SIPO conducted public oral hearing of request for invalidation of the patent of Dow Corning (China) mentioned above.

On May 18, 2015, Patent Reexamination Board of SIPO formally issued a document which declared the entire invalidity of patent right of patent of Dow Corning involved in the case with patent number of ZL03824673.2.

Therefore, China Electronics Materials Industry Association helped domestic silica gel producing enterprises obtain a complete victory in the patent case.
